Theme usage terms and conditions

1.) General.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SOFTWARE. USING AN ADVANCED DYNAMIC DISPLAY BLOCK THEME IMPLIES THAT YOU HAVE READ AND ACCEPTED THE TERMS AND CONDITIONS OF USE. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS, DO NOT USE THE SOFTWARE.

2.) Changes to the terms and conditions.

We reserves the right, at its sole discretion, to modify, change, add or remove any portion of these terms and conditions at any time, in whole or in part. Changes in these terms and conditions will be effective when posted. You acknowledge to review these terms and conditions periodically to be aware of any changes. Your continued use of the software after any changes to these terms and conditions will be considered acceptance of those changes.

3.) Permitted license use and restrictions.

Single usage licence:
This license allows you to install and use one copy of the theme on one domain/website at a time. You may make copies of the Software in machine-readable form for backup purposes only; provided that the backup copy must include all copyright or other license notices contained in the original package. You need to purchase another copy of the software if you want to use the software on another domain or website.

4.) Derivative code.

All derivative code of Drupal and Other GPL software, included in the theme files, are not governed by this license, and fall under the rules of the GPL or respective license. However, other files like images, CSS and JavaScript are copyrighted by us.

5.) Modifications.

You are authorized to make any necessary modifications to fit your own needs, prohibited that you leave the copyright notice and licenses intact. You must also add prominent notices to the changed files that you changed the files and the date of any change. You are not allowed to use the original and the adjusted theme at the same time. You may not redistribute or re-release the themes, modified or not, under any license whatsoever. You agree to prevent any unauthorized copying of the Materials.

6.) Ownership of theme files.

All the theme files are copyrighted and protected by worldwide copyright laws and treaty provisions. Besides the website the theme is used on, the theme files which are not a derivative work of Drupal may not be reproduced, published, uploaded, posted, transmitted, or distributed in any way, without the prior written permission. Any kind of separate usage or distribution is strictly prohibited. You do not claim intellectual property right or exclusive ownership of any file in the theme, modified or unmodified.

7.) Termination of this License.

We may terminate this license at any time if you breach the Terms of Use. Upon termination, all license rights granted will cease and you agree to destroy the Materials immediately.

8.) Disclaimer of Warranties.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. THE SOFTWARE IS PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND WE HEREBY DISCLAIM ALL WARRANTIES. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR AN AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY.

9.) Limitation of Liability.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE.
